1. Operator / About these Terms
The website getmagic.cv and the MagicCV service (the “Service”) are operated by TechMagic UK Ltd (“MagicCV”, “we”, “us”), a company registered in England and Wales.
Registered address: 41 Devonshire Street, Ground Floor, London, W1G 7AJ, United Kingdom. Company registration number: 13076002 · VAT number: GB 409 6531 89 · Contact e-mail: hello@techmagic.co · Director / authorised representative: Artem Grebinnyk, Director.
Data protection supervisory authority: Information Commissioner's Office (ICO), United Kingdom.
UnresolvedAs MagicCV systematically and non-occasionally processes personal data of data subjects located in the European Union, TechMagic UK Ltd has appointed [•], located in [EU member state — to confirm], as its representative in the EU under Art. 27 GDPR. Contact details of the EU representative: [•].
By creating an account or using the Service, the customer (“Customer”, “you”) agrees to these Terms, which incorporate by reference the Privacy & Cookie Policy and the Data Processing Agreement (“DPA”).
2. The Service
MagicCV provides a cloud-based software-as-a-service (SaaS) platform, accessible via the website getmagic.cv, allowing consulting and professional-services firms to store, search, and generate CVs/consultant profiles, including AI-assisted matching of profiles against briefs or requests for proposals (“RFPs”). No software is installed on, downloaded to, or transferred to Customer's own systems; access is provided remotely for the duration of the subscription.
3. Technical Requirements
Access to the Service requires: a device with an internet connection; a modern web browser (a current version of Chrome, Edge, Firefox, or Safari) supporting JavaScript and accepting cookies; and an active e-mail account for verification and communications.
- The use of bots, scripts, or other automated means to access or interact with the Service without MagicCV's prior written consent is prohibited.
- MagicCV applies reasonable technical safeguards (see Annex B to the DPA), but Customer acknowledges that use of the internet carries inherent security risks, including exposure to malicious software or unauthorised third-party access, and is encouraged to use up-to-date anti-virus and security tools on its own systems.
4. Accounts
Customer is responsible for maintaining the confidentiality of login credentials and for all activity under its account, and must ensure that any individual it authorises to use the Service (“Authorised User”) complies with these Terms.
By accepting these Terms, the individual completing registration represents and warrants that they are authorised to act on behalf of, and to bind, Customer to these Terms; MagicCV may require reasonable evidence of such authority.
5. Business Use Only; Consumer Status
The Service is designed, marketed, and provided exclusively for use by businesses in connection with their trade, business, craft, or profession. By registering for or using the Service, Customer represents and warrants that: (a) it is entering into these Terms wholly or predominantly for purposes related to its trade, business, craft, or profession, and not as a consumer; and (b) the individual accepting these Terms on Customer's behalf is authorised to bind Customer to these Terms.
Customer acknowledges that, on this basis, statutory consumer protections that apply only to consumers (or, where applicable under local law, to individuals treated as consumers for certain purposes) do not apply to the Agreement between the parties.
If Customer is a sole trader, freelancer, or other individual acting other than wholly for business purposes, Customer must not register for or use the Service, and must notify MagicCV immediately if this representation ceases to be accurate.
6. Customer Data and CV Data
“Customer Data” means data uploaded to the Service, including CVs and profile information relating to Customer's consultants/employees (“CV Data”). Customer represents and warrants that it has all necessary rights and legal bases to upload CV Data and to permit its processing as described in these Terms and the DPA.
As between the parties, Customer retains all rights in Customer Data. MagicCV processes CV Data solely as a processor, on Customer's instructions, as set out in the DPA.
7. AI features
The Service uses artificial intelligence, including third-party AI models, to parse CVs and generate or reshape CV content in response to prompts, briefs, or RFPs supplied by Customer. AI-generated output may contain inaccuracies; Customer is responsible for reviewing output before external use (e.g. submission to a client or tender).
MagicCV will not use CV Data to train, fine-tune, retrain, or otherwise improve any AI model unless and until Customer has given its prior, explicit, and documented instruction authorising such use, as set out in the DPA. Because MagicCV processes CV Data solely as a processor, MagicCV does not determine the legal basis for any such use — that determination, and the decision whether to authorise it, rests with Customer as controller. Absent such an instruction, CV Data is used solely to provide the Service to Customer.
Customer must not rely on AI-generated matching or scoring output as the sole basis for a final decision that materially affects a consultant (such as project assignment, engagement, or termination); Customer must ensure a human review and final decision by an authorised individual in each such case.
8. Fees and plans
Fees are as set out on the pricing page (getmagic.cv/pricing) or an applicable order form. Free plan limits and Pro/Enterprise plan terms apply as published from time to time. Fees are payable in advance and are non-refundable except as required by law or expressly stated.
For fixed-term subscriptions that renew automatically, MagicCV will notify Customer by e-mail at least 30 days before the renewal date, stating the renewal date and applicable fees. Customer may cancel auto-renewal at any time before the renewal date via account settings or by contacting hello@techmagic.co
9. Term and termination
These Terms apply for the subscription term selected at sign-up and renew automatically unless cancelled. Either party may terminate for material breach not cured within 30 days of written notice. On termination, MagicCV will make Customer Data available for export for 30 days and will thereafter delete it in accordance with the DPA.
MagicCV may suspend Customer's access to the Service for non-payment or breach of these Terms without immediately deleting Customer Data. Customer Data will be retained, without further processing beyond storage, for up to 30 days during any such suspension. If the suspension has not been resolved within that period, MagicCV may terminate these Terms and delete Customer Data in accordance with the DPA.
10. Intellectual property
MagicCV and its licensors retain all rights in the Service, including software, templates, and branding. No rights are granted except as expressly set out in these Terms.
11. Marketing; Use of Customer Name and Testimonials
Customer grants MagicCV a non-exclusive, royalty-free licence to use Customer's name and logo (in the form provided by Customer) to identify Customer as a user of the Service in MagicCV's marketing materials, website, and sales presentations, and to use feedback or testimonials voluntarily submitted by Customer for the same purposes, provided that MagicCV does not materially alter their meaning. Either party may revoke this licence prospectively at any time by written notice, in which case MagicCV will remove the relevant material within a reasonable time.
12. Confidentiality
Each party will protect the other's confidential information with the same degree of care it uses for its own confidential information, and not less than reasonable care.
13. Acceptable Use
Customer and its Authorised Users must not use the Service to:
- Upload CV Data or any personal data without a lawful basis and, where required, the knowledge/consent of the individual concerned;
- Upload special category data (health, ethnicity, religion, etc.) or data relating to criminal convictions and offences, under any circumstances;
- Reverse-engineer, scrape, or attempt to extract the Service's underlying models, software, or database in whole or in part;
- Circumvent security features, rate limits, or access controls, or attempt unauthorised access to any account, system, or data;
- Upload malicious code, or use the Service to build a directly competing product;
- Use the Service in violation of applicable law, including export control, sanctions, employment, or data protection law;
- Misrepresent AI-generated CV content as verified fact without appropriate review.
Breach of this Section may result in suspension or termination of access, in addition to any other remedies available under these Terms.
14. Warranties and disclaimers
MagicCV will provide the Service with reasonable skill and care. Except as expressly stated, the Service is provided “as is”, and MagicCV disclaims all other warranties to the extent permitted by law.
15. Limitation of liability
Unresolved[Placeholder — set a liability cap and carve-outs consistent with UCTA 1977 reasonableness requirements, e.g. cap at fees paid in the preceding 12 months, with an uncapped/higher cap for data protection and confidentiality breaches. STILL PENDING COMMERCIAL DECISION: the multiplier for the super-cap and the claims period have not yet been confirmed. Do not publish these Terms with this Section left in placeholder form.]
16. Data protection
Each party will comply with applicable data protection law. Processing of CV Data is governed by the DPA, and use of personal data relating to Customer's own personnel/account users is governed by the Privacy & Cookie Policy.
17. Changes to the Service or Terms
MagicCV may update the Service and these Terms from time to time; material changes affecting Customer's rights will be notified with reasonable advance notice.
18. Governing law and disputes
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save that either party may seek injunctive relief in any competent jurisdiction.
19. General
- Entire agreement: these Terms, the Privacy & Cookie Policy, and the DPA constitute the entire agreement between the parties regarding the Service.
- Assignment: neither party may assign these Terms without the other's consent, except to an affiliate or successor in a merger/acquisition.
- Severability: if any provision is unenforceable, the remainder remains in effect.
